Thông tư 19/2015/TT-BKHĐT quy định chi tiết lập báo cáo thẩm định trong quá trình tổ chức lựa chọn nhà thầu quy định việc lập báo cáo thẩm định hồ sơ mời quan tâm, hồ sơ mời thầu, kết quả lựa chọn nhà thầu, kết quả đánh giá hồ sơ,… được ban hành ngày 27/11/2015. 1. Áp dụng mẫu báo cáo thẩm định trong quá trình tổ chức lựa chọn nhà thầu- Đối với gói thầu thuộc dự toán mua sắm thường xuyên, việc trình duyệt hồ sơ mời quan tâm, hồ sơ mời sơ tuyển, hồ sơ mời thầu, hồ sơ yêu cầu, kết quả đánh giá hồ sơ quan tâm, kết quả đánh giá hồ sơ dự sơ tuyển, kết quả đánh giá hồ sơ đề xuất về kỹ thuật, kết quả lựa chọn nhà thầu thuộc trách nhiệm của đơn vị do bên mời thầu thành lập hoặc lựa chọn. - Các báo cáo thẩm định áp dụng các Mẫu ban hành kèm theo Thông tư số 19. - Đối với các gói thầu thuộc dự án sử dụng vốn hỗ trợ phát triển chính thức, vốn vay ưu đãi phát sinh từ điều ước quốc tế, thỏa thuận quốc tế giữa Việt Nam với nhà tài trợ, trường hợp nhà tài trợ chấp thuận thì có thể theo các mẫu báo cáo thẩm định tại Thông tư 19/2015/BKHĐT; trường hợp cần thiết có thể sửa đổi nội dung mẫu báo cáo thẩm định phù hợp với quy định về đấu thầu trong điều ước quốc tế, thỏa thuận quốc tế đó. - Đối với gói thầu áp dụng phương thức hai giai đoạn, gói thầu hỗn hợp, trường hợp lập báo cáo thẩm định kết quả đánh giá hồ sơ dự thầu giai đoạn một, kết quả đánh giá hồ sơ đề xuất về kỹ thuật, kết quả lựa chọn nhà thầu thì có thể chỉnh sửa các Mẫu tại Thông tư số 19/2015/TT-BKHĐT cho phù hợp. - Trường hợp sửa đổi nội dung các Mẫu ban tại Thông tư 19 của Bộ Kế hoạch đầu tư thì tổ chức, cá nhân thực hiện việc thẩm định phải bảo đảm việc chỉnh sửa đó là phù hợp, khoa học, chặt chẽ hơn so với các Mẫu tại Thông tư số 19 năm 2015 của Bộ KHĐT và không trái pháp luật đấu thầu. - Đối với chào hàng cạnh tranh rút gọn và chỉ định thầu rút gọn, không bắt buộc phải tiến hành thẩm định Bản yêu cầu báo giá và Dự thảo hợp đồng. 2. Thời gian thẩm định lựa chọn nhà thầuThời gian thẩm định lựa chọn nhà thầu tối đa là 20 ngày kể từ ngày tổ chức thẩm định nhận được đầy đủ hồ sơ trình đến ngày có báo cáo thẩm định lựa chọn nhà thầu. Đối với thẩm định kết quả lựa chọn nhà thầu, trường hợp gói thầu áp dụng phương thức một giai đoạn hai túi hồ sơ, thời gian thẩm định được tính là tổng thời gian thẩm định kết quả đánh giá hồ sơ đề xuất về kỹ thuật và thẩm định kết quả lựa chọn nhà thầu. Thông tư 19 về lập báo cáo thẩm định trong quá trình tổ chức lựa chọn nhà thầu có hiệu lực từ ngày 15/01/2016.
